Fait rare : le gouvernement et l’opposition ont adopté une position commune sur un sujet important mardi au Parlement. Les deux sont en faveur d’une loi qui obligerait les hauts fonctionnaires à déclarer leurs avoirs.
Reste à voir comment cette vision commune sera traduite dans les faits.
Il y a deux étapes dans la lutte contre la corruption dans la fonction publique. Il faut d’abord contraindre les commis d’Etat à lever le voile sur leurs biens mal acquis et ensuite agrandir le fi let anti-corruption. Sous les lois actuelles, un enrichissement qui ne peut être justifié par des revenus légitimes ne constitue pas, en soi, un délit.
La Prevention of Corruption Act (POCA) ne donne pas à la commission anti-corruption le pouvoir d’enquêter sur l’enrichissement illicite des fonctionnaires. Il lui faut réunir les preuves d’une transaction entre le corrupteur et le corrompu avant d’intenter des poursuites. Ainsi, une richesse inexplicable, même si elle est étalée de manière ostentatoire, ne saurait donner lieu à une enquête.
Dans les grandes démocraties, il est possible de réclamer des comptes aux potentats qui mènent un train de vie princier et qui possèdent des voitures et des villas luxueuses. En Inde, par exemple, un haut fonctionnaire peut être arrêté et poursuivi pour «holding assets disproportionate to his known income».
Chez nous, un certain nombre de commis d’Etat ont amassé des fortunes sans proportion aucune avec leurs revenus déclarés mais ils ne peuvent être inquiétés par l’ICAC. Tout au plus, ils risquent une amende de la MRA.
C’est l’affaire Yodhun Bissessur qui a inspiré la convergence d’idées relevée au parlement. Il est bien entendu que le Chief Government Valuer ne fait l’objet que d’une inculpation provisoire et qu’il doit bénéficier de la présomption d’innocence, mais les faits qui remontent à la surface, concernant sa fonction, sont troublants. Ils laissent entrevoir un système qui ouvre la voie à la corruption. Ce haut fonctionnaire n’est pas le seul qui dispose de pouvoirs discrétionnaires théoriquement monnayables.
Bien d’autres occupent des postes qui offrent des opportunités de mettre du beurre dans les épinards.
Nos législateurs sont d’accord qu’il faut renforcer les lois contre les fonctionnaires véreux. Il faut maintenant passer de la parole aux actes.

la lutte contre la corruption dans la fonction publique./ There is nothing wrong with people being paid a high salary for high quality work. Where it goes wrong is when people are promoted to positions above their abilities. Well, I think you get what you pay for ... In this respect we get rich, elitist, egotistical civil servants who are far from in touch with the people who pay them. In Britain David Cameron used his first podcast to hail a new era of government transparency, promising to "rip off the cloak of secrecy" surrounding government information. His first step in fulfilling his pledge is to release this data about the salaries of senior Whitehall officials. Singapore has a professional civil service and her courts are second to none in discharging fair and just decisions based on the laws of the land. Lee Kuan Yew is an avowed atheist compared to our overtly religious Mauritian politicians. But compare how Singapore is a highly principled and moral society where corruption is negligible, where volunteerism is high and where economic benefits are shared by all. Singapore's past achievements can be attributed to its having a strong government and an honest and efficient civil service. The Government has been a regulator and guardian, ensuring that when rules were broken, whoever broke the rules would face the consequences. The Corrupt Practices Investigation Bureau (CPIB) was established under the Prime Minister so that it stayed independent and favoured no particular government agency. No businessman could escape the law if he was caught committing fraud. No civil servant or politician was spared if he was found putting his hand into the official till. The law was not just for show, it was rigorously implemented. Civil servants knew that they had not only to observe the law, but had to be seen to do so. Propriety was the cardinal quality expected of a civil servant and this meant strictly obeying the rules. The conventional wisdom was that if rules were followed, things would work and investors would come to Singapore to do business because good governance meant certainty in the cost of doing business and assurance of legal redress of any wrongdoing. In Singapore, nobody argues that a certain level of corruption should be permissible for cultural or economic reasons. Instead of a culture of high tolerance for gift-taking, it is assumed that accepting a gift puts a civil servant at risk and makes him vulnerable to corruption. Any civil servant who deems it rude not to accept a gift from a foreigner must declare the gift and pay for it if he wants to keep it. The onus is put on the civil servant or politician to prove his innocence if he is found to have unexplainable wealth. No one doubts that looking after one's family should not mean that one can make illicit use of public funds to keep relatives comfortable. The economic argument - i.e. that a small bribe to move things along is helpful to commerce - is totally unacceptable in Singapore. But we believe in paying a civil servant enough to prevent him from accepting bribes to supplement his income. As we try to match private sector pay and build up civil service values, our hope is that beyond a certain comfort level, the civil servant will be motivated by a sense of purpose and mission. Given the Public Service Ethos of service to the nation, dishonesty is also a betrayal of our fellow Mauritian. We will still need to enforce the law strictly as there will always be corruption in any society. But with political will and the right balance of incentives and deterrence, we can reduce corruption while inculcating a new mindset in the Civil Service to better prepare Mauritius for the future.
