Quand on lit le courriel où Raj Bungsraz parle de sa rencontre avec Harry Tirvengadum, on ne peut s’empêcher de sourire devant tant de naïveté, ni de se demander comment quelqu’un qui a déjà travaillé à Air Mauritius puisse ne pas savoir que le procès contre son lointain prédécesseur au poste de Chief Executive Officer a été suspendu. Etc. etc.
Si cette situation n’était pas aussi tragique pour le niveau de moralité de ce pays, on aurait eu presqu’envie de tourner le tout en dérision, se disant qu’il l’a fait exprès. Car il est humainement impossible de s’enferrer dans une telle situation (mis à part Pierre Richard dans ses comédies).
Mais l’épisode Bungsraz/Tirvengadum soulève pas mal de situations gênantes pour certains…
On songe, notamment, au manque de réaction des politiques dont les formations sont représentées à l’Assemblée nationale. Cela confine presque à une conspiration du silence.
On se demande aussi comment Bungsraz a pu avoir accès au grand malade qu’est Harry Tirvengadum. Qui a pu l’y emmener ? Quelqu’un qui connaît bien les allées du pouvoir ? Une personne qui, malgré les aléas de l’existence, a su rester tout près des puissants ?
Autre interrogation : comment un professionnel de la santé pourrait expliquer ce prompt rétablissement qui n’a de précédent que dans la Bible ?
Par ailleurs, se pourrait-il que la teneur des conversations que Bungsraz a eues avec Tirvengadum relève d’une infraction aux règles de fonctionnement d’une compagnie, concernant notamment la divulgation d’informations confidentielles ?
D’ailleurs, Bungsraz lui-même écrit dans son désormais fameux mail : «To put it gently he was quite shocked (and even outraged) with some of the things that we discussed…»
Et, ironie de situation, il ajoute : «More to come[…].»
C’est aussi le souhait de beaucoup de citoyens mauriciens, M. le CEO.

Under this 2003 Act, The Court of Appeal can now quash an acquittal and order a retrial when NEW AND COMPELLING evidence is produced.
In the case of SHT, he was not even FULLY TRIED, let alone AQUITTED. The case was simply put on hold on the ground of so-called compelling medical evidence that he was deemed to be INCOMPETENT TO STAND TRIAL. Competency to stand trial revolves around the state of mind of an accused. A simple diagnosis of schizophrenia or a common mental illness does not automatically result in incompetency to stand trial. It is the degree of functional impairment as a result of the mental illness which is the test. That is, was the accused ( Sir Harry) in a state of mind that prevented him from understanding the nature of the proceedings or even consulting with his Counsel in the course of making the defense. It is important to distinguish between the defendant’s mental state at the time of the trial and the defendant’s state of mind at the time the crime(s) was (were) committed. In the latter case, legal insanity is invoked to seek relief of criminal responsibility.
In the light of the recent and clearly a full 180 degrees medically un-explained but for a Divine intervention reversal condition of the state of mind of SHT, where upon he took part in a high level strategic business meeting where technical and highly complex issues such hedging was discussed and where his advice was much appreciated, this raises the very important question of the standard and tests that was used by our Courts (let alone the Full bench!), in deciding incompetency to stand trial.
In 2005, when the UK Double Jeopardy was struck off, the then Home Secretary ( Interior Minister) stated that "It is important the public should have full confidence in the ability of the criminal justice system to deliver justice”. Should we expect or deserve less? History will tell.

Bungsraz avait déjà fait ses preuves à Air Mauritius et il n'avait pas laissé de bons souvenirs quant à son efficacité.
